US DOJ loses another labor antitrust case after judge grants aerospace executives' motions for acquittal

( April 28, 2023, 13:29 GMT | Official Statement) -- MLex Summary: A US federal judge granted motions for acquittal filed by six aerospace industry executives who were being prosecuted for allegedly fixing wages and entering into no-poach agreements by the US Department of Justice. "There were statements in e-mails suggesting a blanket agreement not to hire," US District Judge Victor A. Bolden wrote in an order. "The alleged agreement, however, allowed for exceptions that were regularly used even during periods of hiring 'freezes,' such as the exception that a supplier company could hire engineers and other skilled laborers if they separated from their prior employer," he said. The judge wrote that assuming that the shifting hiring restrictions are part of an overarching agreement, they suggest that often hiring was permitted and sometimes on a broad scale.
