LCMC Health says acquisition deal with HCA not subject to US Hart-Scott-Rodino review

( April 19, 2023, 19:52 GMT | Official Statement) -- MLex Summary: LCMC Health filed a US complaint seeking to foreclose a challenge by the Federal Trade Commission to its acquisition of Tulane University Medical Center, Lakeview Regional Medical Center and Tulane Lakeside Hospital from HCA Healthcare. LCMC asked a federal judge to issue a declaratory judgment that the Hart-Scott-Rodino Antitrust Improvements Act doesn't apply to transactions that are immune from federal antitrust laws under the doctrine of state action immunity. LCMC said the Louisiana state legislature and attorney general expressly and unequivocally concluded that the acquisition furthers the state’s policy goals for the health and welfare of its citizens.
