Twitter strikes out again on bid for emergency US injunction against Texas investigation over content moderation

( June 30, 2021, 23:16 GMT | Official Statement) -- MLex Summary: A US appeals court turned down Twitter's request for an emergency preliminary injunction against a Texas attorney general demand for information on the company’s content moderation policies. In a 2-1 decision, US Court of Appeals for the Ninth Circuit Judges Jacqueline Nguyen and Ryan Nelson wrote that Texas Attorney General Ken Paxton has no authority to sanction Twitter for failing to comply with his civil investigative demand without mounting a separate court action. "Moreover, Twitter has not provided facts sufficient to support a real risk of imminent harm through self-censorship or otherwise," they wrote. Judge Barry Silverman dissented, writing that Twitter's claim is ripe and Twitter should have an injunction pending full resolution of the appeal.See attached document....
