Google opposes sanctions motion in monopoly case, says US DOJ, states didn't show deleted employee chats would alter case

( April 14, 2023, 23:11 GMT | Official Statement) -- MLex Summary: Google had disclosed its auto-delete default approach on employee chats to the US Department of Justice and a multistate coalition suing the tech giant for alleged monopolization of the online search market, it told the US District Court for the District of Columbia. In requesting leave to file a sur-reply opposing the DOJ and states' motions for sanctions, Google said the government hasn't offered "a single shred of evidence" that a chat would somehow provide unique new information about the company's long-standing contracts with third parties or the design of its publicly accessible search results page. Discovery has long concluded and "if ever Plaintiffs can articulate prejudice, they are 'positioned' to do so now," but they do not and cannot demonstrate any missing chat that would have substantively altered the manner in which the cases were litigated, Google said.See attached document....
