Vietnam issues long-awaited personal data protection decree

( April 18, 2023, 09:47 GMT | Official Statement) -- MLex Summary: Vietnam has finally issued its long-awaited comprehensive personal data protection decree. Effective from July 1, the decree is largely based on the European Union's privacy law and has extra-territorial scope. It defines basic and sensitive personal data, states the rules for consent-based processing and exceptions to it, and outlines the responsibilities of data controllers and data processors, including a 72-hour breach notification. For cross-border transfers, it requires impact assessments and notifications to be submitted to the implementing agency, the cybersecurity department of the Ministry of Public Security. A two-year grace period applies to certain small and medium-sized enterprises not directly engaged in personal data processing.The decree is attached. ...
