Germany failed to correctly transpose EU energy-market rules, legal opinion says

( January 14, 2021, 09:48 GMT | Official Statement) -- MLex Summary: The German government has failed to correctly write into national legislation EU rules on the internal electricity and gas markets, an Advocate General has said in a non-binding legal opinion to the EU’s top court. Giovanni Pitruzzella's opinion aligns with that of the European Commission. The commission referred Germany to the Court of Justice of the EU in 2018, on allegations it hadn’t ensured full respect of 2009 rules on the powers and independence on the national energy regulator in its laws, and that it failed to correctly transpose provisions regarding the “unbundling” of the independent transmission operator and the definition of vertically integrated undertakings. A judgment by the EU’s top court on this case is due at a later date.The Advocate General's opinion in German is attached. The case reference number is C-718/18....
