T-Mobile loses bid to transfer US suit challenging 2020 merger with Sprint to New York district

( October 7, 2022, 22:45 GMT | Official Statement) -- MLex Summary: Defendant T-Mobile has lost a motion to transfer a suit which challenges its 2020 merger with Sprint to the US Southern District of New York from the US Northern District of Illinois. "It is hard to deny that T-Mobile’s request to transfer this case to SDNY at least creates the appearance of forum shopping, given that any purported efficiency gain in that district is speculative and it is not T-Mobile’s home district," US District Judge Thomas Durkin said in an order. The court found that on balance, T-Mobile hasn't met its burden of showing that the Southern District of New York is clearly a more convenient forum for this case than the Northern District of Illinois.See attached document....
