​Port access charges are central to Australian competition regulator's Federal Court appeal

The Australian Competition & Consumer Commission is appealing a decision by the Australian Competition Tribunal to determine an access charge for Glencore at the port of A$1.01 ($0.69) per gross metric ton. The ACCC had determined an access charge in its role as the original arbitor in the dispute as A$0.61 ($0.41) per gross metric ton. A significant part of the dispute is about whether the costs that Port of Newcastle Operations is allowed to recover should include the costs for dredging the shipping channel that were historically funded by various port users, the ACCC said today. ACCC Chairman Rod Sims said in a statement that "the ACCC does not consider it to be economically efficient for a service provider to be allowed to charge any user for costs of assets that have already been funded by users."The full statement follows: ...
