Public interest groups push Ninth Circuit to rehear Amazon-Multi Time trademark appeal

( July 28, 2015, 20:39 GMT | Official Statement) -- MLex Summary: Public Citizen and the Electronic Frontier Foundation filed an amicus in support of rehearing a decision by the US Court of Appeals for the Ninth Circuit reversing a summary judgment for Amazon.com in a trademark case against the company. The organizations urged the Ninth Circuit to consider whether initial interest confusion about the possible sponsorship of a linked web site can be a basis for trademark infringement even if there is no likelihood of confusion once the web site itself is viewed. The brief says that allowing for such infringement unduly burdens companies that post materials online that may be included in search engines and would allow trademark owners to seek judicial rulings to keep information about competing products off search engines. See document below. ...
