Ted Frank asks US Court of Appeals for the Eleventh Circuit for en banc review of objections to Equifax consumer class action settlement

In a court filing, Frank renews his arguments that the settlement should have allowed residents of states with statutory damages statutes to pursue claims as a subclass. He also again accuses the settlement opinion issued by the Northern District of Georgia of being a verbatim adoption of a class counsel ex parte document, saying such an action goes against circuit precedent. See document....
