Judge allows Washington's antitrust case to go forward against state health care deal

Settle has denied The Doctors Clinic and CHI Franciscan Health’s motion to dismiss a challenge by the State of Washington against CHI Franciscan’s acquisition of the assets of WestSound and agreements with The Doctors Clinic. Settle said that the state has sufficiently alleged a horizontal price fixing agreement between two distinct economic entities. “Accordingly, the state has plausibly established a cognizable claim that defendants’ agreement falls into the defined category of agreements in which ‘courts can predict with confidence that [the agreement] would be invalidated in all or almost all instances under the rule of reason . . . .’”See document below....
