Abbott secures win with Unified Patent Court ordering complete revocation of Dexcom glucose monitor patent

The parties are competitors in the market for continuous glucose monitors, or CGMs. In addition to declaring Dexcom's patent invalid, the UPC issued several key rulings relating to jurisdiction, clarifying that it can entertain a request to revoke patent claims not alleged by a plaintiff to be infringed, and that it is not obligated to defer to a parallel national court case that was initiated first.One day after issuing broad injunctive relief to a patent owner in its first merits decision, the Paris Division of the Unified Patent Court, or UPC, on July 4 issued their second merits decision — this time ruling in favor of a defendant and revocation counterclaimant....
