Judge trims Vyera Pharmaceuticals, Shkreli, Mulleady defenses against US FTC suit

( December 28, 2020, 23:33 GMT | Official Statement) -- MLex Summary: Vyera Pharmaceuticals and former executives Martin Shkreli and Kevin Mulleady can't assert a defense that the US Federal Trade Commission failed to allege an ongoing conspiracy, US District Judge Denise Cote ruled, granting the FTC's motion to strike the defense in its antitrust suit against Vyera and the executives. Cote also found that Shkreli can't assert defenses that he didn't possess market power as an individual and didn't enter into or sign any agreements with distributors, hospitals, API suppliers or other downstream purchasers. See document below. ...
