In first merits decision, Unified Patent Court declares patent, as amended, inventive and infringed

The Court of First Instance of the Local Division at Düsseldorf declared three amended claims of a Franz Kaldewei GmbH & Co KG patent directly and contributorily infringed by Bette GmbH & Co. KG., and ordered broad injunctive relief — including an immediate halt by Bette of certain sales and instructions to recall existing products on the market.The Unified Patent Court, or UPC, today ordered Bette GmbH & Co. KG to recall various shower floor products in Austria, Belgium, Denmark, France, Italy, Luxembourg and the Netherlands....
