UK judge declares Abbott patent invalid, not infringed by Dexcom’s ‘G7’ continuous glucose monitor

Judge James Mellor of the High Court of Justice Intellectual Property Court said the prior art “disclosed not just the idea of an integrated” analyte monitoring device but also “considered details of how to implement and deliver such a device.” Allegations by Abbott, maker of the Freestyle Libre glucose monitor, that Dexcom Incorporated, maker of the competing G7 glucose monitor, relied on hindsight to make a case for obviousness were rejected.For the second time this year Dexcom Incorporated has prevailed in court on allegations of patent infringement leveled by Abbott Diabetes Care in connection with European Patent 3 730 044 B1, or EP044....
