DOJ plans to seek disqualification of Pomerantz, his firm from states' T-Mobile-Sprint challenge

( November 8, 2019, 23:31 GMT | Official Statement) -- MLex Summary: The Department of Justice wrote a letter to US Magistrate Judge Robert Lehrburger asking for a pre-motion conference before it requests the disqualification of Glenn Pomerantz, a lawyer representing New York and California in a multistate lawsuit to block T-Mobile from acquiring Sprint. The DOJ said Pomerantz and his firm, Munger, Tolles & Olson, should be disqualified because Pomerantz previously served as a lead trial counsel for the US in its lawsuit to block AT&T's proposed acquisition of T-Mobile. The letter says Pomerantz had access to confidential government information that creates a conflict. "This disqualifies Mr. Pomerantz (and his law firm) under longstanding ethical limits on the activities of former government attorneys. The United States seeks to bring this motion after careful consideration and consultation with career bar ethics experts within the Department of Justice," the letter says.See document below....
