Broadband associations file for judgment on the pleadings in Maine ISP privacy lawsuit

( April 6, 2020, 20:00 GMT | Official Statement) -- MLex Summary: Broadband industry associations suing Maine in federal court over the state's Internet service provider privacy law are asking US District Judge Lance E. Walker for judgment of the pleadings, arguing that the law is clearly unconstitutional. "This case is not about whether consumers’ privacy should be protected," write plaintiffs, which include ACA Connects and CTIA – The Wireless Association. "Rather, this case is about whether Maine’s outlier ISP-only privacy regime — which disturbs those evenly applied federal standards — contravenes constitutional limits on Maine’s regulatory authority.
