Capital One files motion to dismiss tort, statutory claims in data breach case

( May 27, 2021, 20:00 GMT | Official Statement) -- MLex Summary: Capital One says a federal judge should dismiss plaintiffs' tort, statutory and injunctive relief claims because plaintiffs have yet to show how the data involved in the financial giant's 2019 data breach has been misused by criminals. "Plaintiffs have therefore not suffered any harm — or risk of future harm — traceable to the Cyber Incident, and they cannot meet their burden of demonstrating Article III standing," Capital One said in the motion to dismiss.
