​GEA Milfos hit by price-fixing fine over ‘grossly careless’ New Zealand technology arrangement

( June 24, 2019, 23:02 GMT | Official Statement) -- MLex Summary: A New Zealand court has ordered GEA Milfos International to pay $NZ825,000 ($544,000) after the technology company admitted to engaging in price-fixing with a competitor, Dairy Automation Limited, or DAL, between October 2012 and September 2014. The anticompetitive behavior came as Milfos and DAL discussed the possibility of Milfos becoming the exclusive retailer of DAL’s milk-sensor products. Although the arrangement was never entered into, Milfos and DAL agreed to use a shared pricing spreadsheet for customer quotes, fixing prices for the milk-sensor products. In his judgement, High Court Judge Edwin Wylie said that Milfos’ conduct had been “certainly careless — even grossly careless.” New Zealand Commerce Commission Chair Anna Rawlings said the case was a “strong reminder to business that they must be mindful of agreeing prices with a distributor that competes with them in the retail market.”New Zealand Commerce Commission statement follows; High Court judgment is attached. ...
