Norfolk Southern Railway files reply in support of summary judgment against CSX's antitrust claims

( May 13, 2021, 22:31 GMT | Official Statement) -- MLex Summary: CSX Transportation’s antitrust claims against Norfolk Southern Railway Company now hinge on not getting a special, lower rate for intermodal traffic, which was never rejected and is precluded by an operating agreement, according to NSRC. It filed a reply in support of summary judgment, arguing that CSX never asked Norfolk and Portsmouth Beltline Railroad Company’s board to vote on its proposals for the special intermodal rate, and the rate conflicts with the operating agreement’s uniform rate provision, which NSRC has the right to rely on.  See document below. ...
