( March 4, 2023, 00:23 GMT | Official Statement) -- MLex Summary: Google’s motion to dismiss publishers’ amended consolidated class action complaint should be denied, publishers said, as the plaintiffs' have sufficiently pleaded Google abused its monopoly power in the publisher ad server market by engaging in a recurring practice of excluding competing ad networks under the pretext of patrolling problematic code. In a filing to the Southern District of New York, publishers said Google is attempting to re-characterize their allegations as challenging a new-and-improved product or as constituting a "disfavored form of refusal to deal." "Google’s new-product argument is a red herring," they said, and no immunity from an antitrust challenge exists for conduct that can be recast as a new product feature.See attached document....
