Apple wrongly applies refusal-to-deal framework to alleged monopolistic conduct in smartphone markets, US DOJ says

( May 31, 2024, 16:59 GMT | Official Statement) -- MLex Summary: Apple is misstating the law and inappropriately attempting to create factual disputes by telling a US federal court that a monopolization lawsuit against the company filed by a Department of Justice-led coalition doesn't plausibly allege monopoly power in a relevant market, anticompetitive conduct, and anticompetitive effects, the DOJ said in a letter filed in the District of New Jersey. "A refusal-to-deal framework is inappropriate because the challenged practices are not refusals to provide requested products or services to smartphone rivals," the letter said.
