Amazon loses motion to dismiss US FTC 'dark patterns' claims

( May 28, 2024, 23:43 GMT | Official Statement) -- MLex Summary: A federal judge in Seattle has denied Amazon's motion to dismiss US Federal Trade Commission claims that the e-commerce giant's overly complicated "Iliad Flow" mechanism to cancel its Prime video service violated the Restore Online Shoppers' Confidence Act (ROSCA) by employing "dark patterns" design choices. US District Judge John Chun found that "the Court cannot conclude as a matter of law that [Amazon's] disclosures would be clear and conspicuous to any reasonable consumer." The judge said he could not find that Amazon complied with ROSCA's requirement to give consumers "a simple mechanism" to cancel online purchases. "Again, viewing the Amended Complaint in the light most favorable to the FTC, the Court cannot dismiss the claim that Amazon’s 'Iliad Flow' cancellation method was not a 'simple mechanism,' ” Chun wrote.See attached document....
