Plaid must defend some privacy claims, US judge says in split decision

( April 30, 2021, 22:15 GMT | Official Statement) -- MLex Summary: Plaid, a fintech company based in San Francisco, will have to defend a number of claims by customers that it violated their privacy by accessing and selling their banking information without permission, a US judge has ruled in Oakland, California. "The question of whether Plaintiffs consented to Plaid’s collection of their personal information is a key factual dispute to be decided on the merits rather than a Rule 12 motion. Whether Plaid’s alleged conduct 'could highly offend a reasonable individual' is also 'an issue that cannot be resolved at the pleading stage,'" US Magistrate Judge Donna Ryu wrote, quoting Ninth Circuit law as she denied Plaid's motion to dismiss allegations that Plaid violated the California Constitution’s right to privacy. However, Ryu granted Plaid's motion to dismiss the plaintiffs' Stored Communications Act, Computer Fraud & Abuse Act, and Unfair Competition Law claims.See attached document....
