Comment: US court decision to accept rare en banc review of Shopify privacy case may have wide ramifications for platforms

By Mike Swift and Xu Yuan ( May 17, 2024, 23:13 GMT | Comment) -- In a decision that could have a significant impact on e-commerce platforms, the US Court of Appeals for the Ninth Circuit this week decided to hold a rare en banc review and erase a decision from last year involving privacy litigation against Canadian e-commerce giant Shopify.  Consumer advocates had argued it would effectively leave Americans with no judicial recourse for harms caused by an e-commerce platform unless the platform’s activities were specifically directed to a single state.Shopify over the last decade has mushroomed from an online snowboard retailer to a sophisticated e-commerce platform that links millions of merchants to consumers in more than 175 countries, allegedly illegally selling personal data from those transactions in the process....
