Federal Circuit sends back Promega-Life Technologies patent case

( December 15, 2014, 23:31 GMT | Official Statement) -- MLex Summary: The US Court of Appeals for the Federal Circuit has reverse a lower court’s denial of summary judgment for Life Technologies as to four patent claims asserted by Promega, determining that they are invalid for lack of enablement. The panel also reversed the court’s judgment of non-infringement as to one patent, finding that substantial evidence supported the jury’s determination of infringement against Life. Finally, the panel affirmed the district court’s finding that the license does not cover all of Life’s sales of the accused products.See document below. ...
