Administrative law judge denies LabMD's motion to dismiss FTC claims in data breach case

Michael Chappell has denied LabMD’s motion to dismiss the FTC’s claims that it failed to reasonably protect the security of consumers’ personal data. Chappell said that resolving LabMD’s due process claims “would require findings of fact, which, at this stage of the proceedings, where the evidentiary hearing is nearly complete, are more appropriately undertaken in the context of the initial decision to be issued in this case.”See document below. ...
