US Court of Appeals: District of Columbia - FTC v. Boehringer Ingelheim Pharmaceuticals [Boehringer final brief]

( October 3, 2013, 22:00 GMT | Official Statement) -- MLex Summary: Boehringer Ingelheim has filed its final brief in the Federal Trade Commission's appeal from a decision holding that documents the agency sought to obtain from it regarding agreements with generic drug manufacturer Barr Pharmaceuticals over the drugs Mirapex and Aggrenox were protected work product and the company therefore did not have to produce them. Boehringer argues that the district court correctly applied the legal standard and "reasonably held that Boehringer’s workproduct documents were prepared at the direction of counsel to assist in making strategic decisions about the patent lawsuits and their settlements and that the documents would not have been prepared absent the litigation and settlements."See document below....
