Federal judge says opt-out plaintiffs cannot use class action findings to prove Dow fixed urethane chemical prices

Lungstrum has denied the opt-out direct action plaintiffs’ motion for partial summary judgment to preclude Dow from relitigating the fact that it was involved in a conspiracy to fix urethane chemical prices in the direct actions. Lungstrum said that class members who opt out of a class action cannot benefit from a factual finding in the class’s favor. See document below....
