PZ Cussons loses attempt to have Australian watchdog pay for costs in detergent cartel lawsuit

( March 22, 2021, 02:09 GMT | Official Statement) -- MLex Summary: PZ Cussons has failed in its attempt to have Australia’s competition enforcer pay for legal expenses in a long-running antitrust case involving allegations of cartel arrangements that included Colgate-Palmolive and Unilever Australia. In a ruling issued late last week, the Federal Court of Australia said that although the Australian Competition & Consumer Commission’s decision to pursue an appeal following an initial defeat in its case had been risky, this didn’t mean that the action was “hopeless or foredoomed to fail,” as PZ Cussons had alleged. In May 2019, the ACCC lost an appeal against PZ Cussons in the Federal Court but wasn't required by the court to cover the company’s legal expenses. This prompted PZ Cussons to file an interlocutory order. The company must now pay the ACCC’s legal costs relating to the interlocutory order.   The full court judgment is attached. ...
