Yershov says Gannett app violated 'concrete' privacy interest created by Congress in VPPA

( July 14, 2016, 21:33 GMT | Official Statement) -- MLex Summary: Plaintiff Alexander Yershov said in a filing with the District of Massachusetts that by enacting the Video Privacy Protection Act, Congress identifed a real interest in the privacy of a person's video-watching history, which a Gannett app invaded by sharing Yershov's video history. The US Supreme Court's recent decision in Robins v. Spokeo, Yershov said in the filing, "confirms that when Congress identifies and protects a concrete interest by statute, a statutory violation that invades that interest results in a cognizable injury, even if the plaintiff suffers no additional harm." Therefore, Gannett's motion to dismiss the case should be denied, Yershov said.Please see attached filing....
