Swisher International gets competitor's $44 million jury verdict thrown out for 'fraud on the court'

( August 19, 2019, 20:00 GMT | Official Statement) -- MLex Summary: A $44 million jury verdict against cigar maker Swisher International in a monopolization case filed by its competitor, Trendsettah USA, was overturned by a federal judge who found the plaintiff concealed critical facts during discovery and presented materially false and misleading information to the court and the jury. Trendsettah's chief executive officer was indicted earlier this year for not paying excise taxes on imported cigarillos, which would have been critical information in the jury trial. Trendsettah committed "fraud on the court" in excluding key evidence, US District Judge James Selna ruled. "In sum, Swisher has shown by clear and convincing evidence that [Trendsettah] engaged in misconduct that undermined the judicial process which went to the central issues in the case."See document below...
