USPTO director confirms imminent changes for PTAB, but says AI rules aren’t ready, ‘nothing in the works’ for SEPs

By Melissa Ritti ( September 23, 2024, 16:36 GMT | Insight) -- An exceptionally busy period of proposed rulemaking by the US Patent and Trademark Office will soon bear fruit for those who practice before the Patent Trial and Appeal Board. That was the message Sunday from USPTO Director Kathi Vidal in a fireside chat at the Intellectual Property Owner’s Association’s annual conference. Regulation elsewhere needs more time, however. Vidal said proposed rules for artificial intelligence are still being fine-tuned, and the USPTO has “nothing in the works” for standard essential patents — choosing, instead, to “shift” its attention to partnering with entitles like the National Institutes of Standards and Technology.US Patent and Trademark Office Director Kathi Vidal will be taking action as early as this fall on all Patent Trial and Appeal Board-related issues presented to stakeholders this spring, including discretionary institutions of inter partes review, or IPR, expansion of the PTAB bar and codification of policies for director review of PTAB decisions....
