Google 'Incognito' ruling won't be revisited in wake of appeals court ruling, US judge says

( September 18, 2024, 00:01 GMT | Official Statement) -- MLex Summary: A federal judge in California denied a motion by 185 plaintiffs in a state court case against Google to intervene given a recent appeals court win by plaintiffs in parallel litigation over Google's collection of personal data through its Chrome browser. US District Judge Yvonne Gonzalez Rogers said a recent ruling by the US Court of Appeals for the Ninth Circuit in Calhoun v. Google didn't require her to reconsider her denial of the state court plaintiffs' motion to intervene in privacy litigation over Google's "Incognito" private browsing mode. "The Court is not convinced that Calhoun demands reconsideration of its prior order in this case. As defendant notes in opposition, at-issue here is an implied consent defense, whereas Calhoun concerned Google’s defense of express consent," Gonzalez Rogers wrote.See attached document....
