House Judiciary Committee adopts amendment to the Innovation Act regarding fee-shifting

( November 20, 2013, 00:00 GMT | Official Statement) -- MLex Summary: The House Judiciary Committee has adopted an amendment to the Innovation Act offered by Representative Hakeem Jeffries regarding awards made to a prevailing party. Jeffries's amendment would require the court to award reasonable fees and other expenses to a prevailing party in a civil action where a claim for relief arising under any act of Congress relating to patents is asserted, unless the court finds that the position and conduct of the nonprevailing party were "reasonably justified" in law or a special circumstance, such as severe economic hardship to a named inventor, would make it unjust. See the amendment in full below....
