Intuitive Surgical must face antitrust claims from Rebotix over surgical instrument repair services, rules US judge

( March 8, 2021, 22:31 GMT | Official Statement) -- MLex Summary: Rebotix Repair has failed to plausibly allege a prior course of voluntary dealing to support its claims that usage counters installed on Intuitive Surgical’s EndoWrist instruments constitutes exclusionary behavior, according to a US federal judge. US District Judge Virginia M. Hernandez Covington dismissed Rebotix’s claims based on those usage counters, but allowed the remaining claims to continue, saying that Rebotix has plausibly alleged that Intuitive has monopoly power in the relevant market of EndoWrist repairs and maintains it through exclusionary tactics.
