Resale price maintenance whistleblowers see reduced benefit scenario under UK CMA guidance revision

( September 24, 2020, 13:24 GMT | Official Statement) -- MLex Summary: Companies that are whistleblowers for already-investigated cases of price fixing through the resale of goods, known as "resale price maintenance," cannot generally be expected to receive immunity from sanction or a penalty discount of more than 50 percent, under a revision to guidance provided by the UK Competition and Markets Authority. That clause has been added to the guidance, even as the original text states that the CMA "may" grant successful applicants immunity or up to a 100 percent discount on any financial penalty. RPM cases are increasingly on the radar of regulators, and the CMA has in recent times imposed sanctions on musical-equipment makers for anticompetitive online pricing behavior.Statement follows.
