Appeals court upholds 'Special Rule' application in precedential ruling resulting from unique ITC vote, affirms trade court's preliminary injunction denial

( January 24, 2014, 23:39 GMT | Official Statement) -- MLex Summary: The US Court of Appeals for the Federal Circuit affirmed the US Court of International Trade's denial of the Wind Tower Trade Coalition's motion for preliminary injunction. The ruling supported the US Department of Commerce’s findings that the 'Special Rule' for assessing duties applies when the commissioners at the US International Trade Commission vote as they did in Wind Trade Towers. As a result of the split ITC vote and DOC's application of the Special Rule, duties would only be applied from the publication date of the ITC’s final ruling.See document below....
