( August 9, 2024, 10:10 GMT | Official Statement) -- MLex Summary: Ten counterfeiting defendants, most of which are located overseas, have asked the US Court of Appeal for the Ninth Circuit to review a recent order awarding Biozeal, maker of the “ChildLife” brand nutritional supplements, its request for $5,299,205.88 in attorneys' fees and $38,336.78 in costs. US District Judge Hernán D. Vera of the Central District of California cited the need to deter TNSG Health, Alps Holding Company, Zhijuan Guo, Qidong Lu, Mom’s Garden Company, Mom’s Garden GmbH, Nature’s Prime, Naturalist, Tilis Company and Wild Forest, Inc. from continuing to infringe the ChildLife trademarks as well as punish the defendants for their litigation misconduct in support of the award. In May, the defendants were ordered by Vera to pay $4 million in damages, jointly and severally, in connection with what the judge called a “shockingly brazen counterfeiting scheme, accomplished in part by [the] submission of specimens of use to the United States Patent and Trademark Office that clearly depicted their counterfeit labels.”See document below....
