Bulk of Shein copyright claims against Temu vendors must be dismissed, US judge rules

( September 9, 2024, 10:10 GMT | Official Statement) -- MLex Summary: Roadget Business PTE, operator of Shein, saw its copyright infringement lawsuit against unidentified vendors for the rival fashion website Temu drastically trimmed this week. US Judge Sara L. Ellis in Illinois said some foreign defendants are entitled to dismissal for lack of personal jurisdiction, while most others must be dismissed for improper joinder. Shein’s bid to sever the latter group into separate lawsuits to preserve a preliminary injunction already entered in the case was denied, with Ellis writing that would allow Shein “to obtain a windfall by dodging filing fees in eighteen cases that it should have brought separately against the vendors that it improperly joined here.” As a result of her ruling, only one defendant remains in Shein’s Illinois lawsuit. Shein and Temu are also litigating issues of copyright infringement and trade secret misappropriation in the US District Court for the District Columbia.See document below....
