Bid-rigging claims in broiler chicken antitrust case bifurcated, put on hold

( September 22, 2020, 22:31 GMT | Official Statement) -- MLex Summary: Claims of bid-rigging against chicken companies such as Pilgrim’s Pride, Amick Farms and others will be stayed and put on a separate track in a larger case accusing the companies of fixing prices by reducing supply and manipulating the Georgia Dock price index, US District Judge Thomas M. Durkin ruled. Durkin determined that while the bid-rigging claims are closely related to the other claims, they were filed fairly late in the progress of litigation and evidence of bid-rigging is not necessary to prove the supply reduction or Georgia Dock claims. “Under Plaintiffs’ theory of the case, all three claims are means to the same end of manipulating Broiler prices. But because they are concededly different means, litigation of those claims does not have to proceed simultaneously,” he said.See document below. ...
