Indirect purchasers file petition for permission to appeal denial of class certification in optical disk drive antitrust suit

( October 17, 2014, 22:00 GMT | Official Statement) -- MLex Summary: The indirect purchaser plaintiffs have filed a petition asking the US Court of Appeals for the Ninth Circuit for permission to file an interlocutory appeal of US District Judge Richard Seeborg's order denying their motion for class certification. They argue that the denial signals a death knell for the plaintiffs; Seeborg improperly decided on the merits of the plaintiffs' common evidence; and he erred in considering whether their overcharge model alone could demonstrate widespread impact to the class instead of considering the totality of the plaintiffs' statiscal and documentary evidence together.See document below....
