Healthgen of Wuhan disputes USITC reliance on testing data, finding of domestic industry for Ventria Bioscience

By Melissa Ritti ( September 3, 2024, 17:33 GMT | Insight) -- Counsel for the US International Trade Commission at oral arguments today defended a limited exclusion order barring Healthgen of Wuhan from importing plant-derived recombinant human serum albumins and various rHSA-containing products to the US. Counsel for Healthgen countered with claims that the commission wrongly relied on testing data from China which failed to allow for the “inevitable” rise in aggregated albumin levels during the shipping process. Healthgen also argued patent owner Ventria Bioscience waived its right to assert the existence of an emerging domestic industry by failing to argue as much until the case made its way to the US Court of Appeals for the Federal Circuit.The US International Trade Commission, Healthgen of Wuhan and Ventria Bioscience squared off today in oral arguments at the US Court of Appeals for the Federal Circuit....
