MLex Comment: Relief as UK Lords rule against Norris extradition on cartel charges

By Lewis Crofts ( March 12, 2008, 12:30 GMT | Comment) -- A ruling by the UK's House of Lords today to block the extradition of a former chief executive at the heart of a global carbon cartel will bring sighs of relief from executives fearing a round-up of company directors involved in pre-2003 cartels. A ruling the other way may have helped elucidate aspects of 'dishonesty' in price-fixing, but the Lords stated that the act of price-fixing itself needs an additional element of deliberate deception to be conspiracy to defraud.A ruling by the UK's House of Lords today to block the extradition of a former chief executive at the heart of a global carbon cartel will bring sighs of relief from executives fearing a round-up of company directors involved in pre-2003 cartels. Establishing that 'conspiracy to defraud' did not constitute a criminal offence will simplify matters for lawyers assessing the risks for individuals caught up in cartels....
