Civil society groups urge senators to oppose the EARN IT Act

( September 15, 2020, 14:28 GMT | Official Statement) -- MLex Summary: More than 25 civil society organizations are urging US lawmakers not to support the EARN IT Act, a bipartisan Senate bill that would repeal the liability shield for third-party content in lawsuits alleging a role in the distribution of child sexual abuse material, or CSAM. The organizations were led by the Center for the Democracy and Technology. The problem, says the letter, is that states would be "free to impose any liability standard they please on platforms, including holding platforms liable for CSAM they did not actually know was present on their services. Nothing in the bill would prevent a state from passing a law in the future holding a provider criminally responsible under a 'reckless' or 'negligence' standard." As a result, EARN IT "would make it far riskier for platforms to host user-generated content," and some online platforms would simply stop doing it.Release and document follow below:...
