Strategic Technology Institute’s ‘PASS’ software infringes former Marine’s competing program, US appeals court affirms

In a ruling this week, the US Court of Appeals for the Fifth Circuit endorsed a jury’s verdict that Security Management and Reporting Tool, or SMART, was infringed by the Personnel Administrative Security System, or PASS, system by Strategic Technology Institute, or STI. The court also confirmed, however, that MGMTL cannot recover on its trade secret misappropriation claims, which require proof of damages under state and federal law.A former active-duty Marine who developed security software using Microsoft Office’s Visual Basics program will keep his $180,000 copyright infringement award....
