Clearview AI must face Vermont lawsuit, state judge rules

( September 11, 2020, 19:49 GMT | Official Statement) -- MLex Summary: A Vermont state judge refused to grant Clearview AI's motion to dismiss a lawsuit launched by the state attorney general. The facial-recognition software maker attempted to bring an early end to the suit by invoking the First Amendment and Section 230 of the Communications Decency Act of 1996. Superior Court Judge Helen Toor dismissed both arguments, writing that the state's claims aren't based on liability related to third-party content, which is what Section 230 shields against. As for the First Amendment, Toor wrote that Vermont's lawsuit isn't based on the content of Clearview AI's speech, but rather its software's ability to "easily identify Vermonters through photographs obtained unfairly and without consent."See statement below:...
