Judge denies AT&T Mobility's motion to dismiss FTC 'throttling' suit

( March 31, 2015, 22:17 GMT | Official Statement) -- MLex Summary: US District Judge Edward Chen has denied AT&T Mobility's motion to dismiss litigation brought by the Federal Trade Commission that the wireless carrier deceived its wireless broadband customers by "throttling" the data transmission rates of customers who had bought "unlimited" data plans. Chen rejected AT&T's argument that it is exempt from regulation by the FTC, because the agency cannot regulate "common carrier" utility services. Chen said the essense of the FTC's complaint was not not about the practice of "throttling per se, but AT&T’s deceptive conduct in failing to disclose its throttling to certain customers." Please see attached order...
