Schlecker's insolvency administrator wins cartel-damages appeal before German supreme court

( November 29, 2022, 10:22 GMT | Official Statement) -- MLex Summary: Schlecker's insolvency administrator has successfully challenged a ruling from a Frankfurt appeal court that threw out its 212 million euro cartel-damages lawsuit against makers of personal care products, cleaning products and detergents. The Federal Court of Justice, also referred to as Bundesgerichtshof, said the lower court was wrong to dismiss damage that Schlecker had suffered from a cartel. There was a presumption that an anti-competitive exchange between competitors about secret information about the current or planned price-setting behavior towards a common customer led to higher prices. The appeal court failed to properly consider this presumption, the Bundesgerichtshof said. It has referred the case back to the lower court.Press release follows....
