Qualcomm must face consumer antitrust claims, judge rules

( November 11, 2017, 01:21 GMT | Official Statement) -- MLex Summary: US District Judge Lucy Koh has denied Qualcomm's motion to dismiss claims brought by consumers that the chip-maker's patent licensing business violates California's Cartwright Act and Unfair Competition Law. Koh, ruling in San Jose, California, also denied Qualcomm's motion that consumers have failed to allege an antitrust harm and lack Article III standing to sue. "Qualcomm’s surcharge affects the ultimate price paid by consumers like Plaintiffs because the cost of modem chips substantially influences the retail price that OEMs, retailers, and distributors charge for a handset," the judge wrote. Koh granted with prejudice, however, Qualcomm's motion to dismiss the consumers' claims that the company violated the Sherman Act to the extent those claims seek damages.Please see attached order....
